Conditions for returning goods
1. Right of withdrawal
The consumer has the right to withdraw from the distance sales contract, without giving any reason, within 14 (fourteen) days from the date on which the consumer or a third party indicated by him, other than the carrier, received the goods. In order to exercise his right of withdrawal, the consumer must, before the expiry of this period, notify "MDecor 1" EOOD of his decision via the Standard Form for exercising the right of withdrawal, located in the buyer's customer profile, or via another unambiguous written application sent to the email: info@malerisamadeit.com To comply with the deadline, it is sufficient for the notification for exercising the right of withdrawal to be sent before the expiry of the 14-day period.
2. Return of the goods
After having notified the trader of his withdrawal, the consumer must send or hand over the goods without undue delay and no later than 14 days from the date of notification. The returned products must be accompanied, where possible, by the proof of purchase (fiscal receipt, invoice or other document proving the purchase). The absence of such a document in itself does not deprive the consumer of the right of withdrawal when the purchase can be established in another way. The consumer has the right to open the packaging and examine the product only to the extent necessary to establish its nature, characteristics and appearance, as he could do in a retail outlet. Using the product for its intended purpose (e.g. washing with soap) is not considered a necessary inspection and may result in a reduction of the refund amount in accordance with the diminished value of the goods or a refusal to return. It is recommended that the products be returned in their original packaging, where available. If the lack of or damage to the packaging leads to a decrease in the value of the goods, the trader has the right to reduce the refunded amount by the value of the depreciation caused.
3. Return costs
The costs of returning the goods are at the expense of the consumer, unless expressly agreed otherwise or if the return is due to a delivered non-conforming, damaged or incorrectly sent product.
4. Refund of the amounts paid
Upon lawful exercise of the right of withdrawal, "MDecor 1" EOOD refunds all payments received from the consumer, including the cost of standard delivery to the consumer. If the consumer has chosen a delivery method that is more expensive than the cheapest standard method offered by the trader, the difference in price is not refunded. The refund of the amounts is made without undue delay and no later than 14 days from the date on which the trader was notified of the withdrawal. The trader has the right to withhold the refund until the returned goods are received or until proof is provided that they have been sent back, whichever is earlier. When paying by bank card, the amount is refunded to the same card used for payment. When paying by cash on delivery or postal money order, the refund is made to a bank account provided by the consumer.
5. Return addresses
Returns of goods should be made after prior notification to the trader. 6. Exceptions to the right of withdrawal
The right of withdrawal does not apply in cases provided for in current legislation, including for goods made to individual order (personalized with text, color and size) or according to the requirements of the consumer, as well as for other goods for which the law excludes the right of withdrawal.
7. Non-conformity of the goods and complaints
These conditions regarding the right of withdrawal do not limit the statutory rights of the consumer in the event of non-conformity of the goods with the sales contract. If a defect or non-conformity is found, the consumer has the right to file a complaint in accordance with the applicable legislation.
